To be honest, it's going to be very difficult to market this musical without people thinking of Loaf. It's "Bat Out Of Hell". People will think Meat Loaf. I guess that's the argument from the bat 3 legal trouble.

It can be done. Just make sure "Jim Steinman's" is printed or said before Bat Out Of Hell every time. And i'd say be very choosy with the Loaf songs. Don't make it a greatest hit's concert.
The music should be chosen to support the story, not distract from it.
And a great vocalist that doesn't sound like Meat Loaf singing Steinman songs would be very welcome.

If he doesn't use a Meat impersonator it has a better chance of it becoming one of the most unique, and maybe respected musicals done. Or it will be a failure, and doomed.
