Fair Use is a construct of structure for reasons and justifications for use of copyrighted material according to several factors of criteria. If called upon I could write the necessary essay to justify this use as Fair Use. I have no problem with that. Linking, copying, and what, is all fair game in fair use. Before you write something you will later disavow, be sure that you know that it can live beyond your intentions. > Dead wrong- would you like to argue with my publisher's > lawyers about it? Why would your publisher spend their money on a personal blog? They would have to shell out around $300 per hour for this set of circumstances. Is it worth it to them? If it is, they know fair use before they know you or me, and they could recognize it well enough. I don't have to argue with someone who already knows far better than what you think may be the case. They wouldn't let themselves look so dumb. > > Fair use would have been to link to it- but when specific > details such as "express written permission" are outlined, > there is no fair use. I did not use it for any other context than arguing the necessary point and showing the context in which your comments were presented. Fair Use is what permits justice to prevail. > > Jacqueline is looking into this now. Who is contacting who, miss doctorate in manipulation? Your rights were given that which is permissible in law. It is equally as permissible for you to write, and for someone to use, within Fair Use without a written permission. It is when someone gratuitously wants to use material to adorn a project, where the permission comes into play. For example, I could not use your blog if I were writing an article about people being trusted by horses and children. But in this instance, it is not a fluff piece, but a dispute, and one that is righteously fought by me using material you provided which is pointedly salient and necessary for its factual resolution. Hence, it is Fair Use. > > > > > Fair use in settlement of a dispute. Sorry Charlie. > > | |
