Whoever owns the right to a song has first publication rights. In this case Jim. After it has been released in a country anybody can license a cover of the song. That's my understanding as it was explained to me my people in the industry. I think it is stupid. I think whoever holds a copyright should have complete control over who can and who can't use a song... But since Jim has not released Safe Sex in America he holds first publication rights and nobody can release it in America until Jim does... even though it has been performed on stage in America by TDE and you can import it on Pandora's Box. It is because of this law that Meat was able to ruin all the Steinman covers on Bat 3. It is why he performed Only When I Feel on Tour... but when it came time for the Album he could only release Break It because Jim had already released Break It on the Wuthering Heights album but Jim would not give him the rights to use Only When I Feel. Meat told me that the people on Bat 3 (My guess is Desmond) were urging him to just go ahead and record What Party Of My Body Hurts the Most and release it even without permission from Jim, but he didn't want to take the chance. Apparently Jim gave him permission to use Seize The Night and Cry To Heaven.
