Well, if she represented herself as legal age and he had no reason to believe she wasn't... then I feel that makes it OK... He can't be expected to demand to see the Bint's driver's license before porking her if she is claiming to be 18 or 21 or whatever unless she looks like a child. I really don't know the details of the case that well.... Did he know how old she was? Did she lie to him about her age?
