I don't believe for one second that the out of court deal they struck was Meat's lawyers telling Jim's lawyers "We use the your trademark for this album, and then you use your trademark for that thing you're doing, and you're not allowed to talk about our thing once it's done, and that's the deal".

Bullllll shit. In the turd fight over the trademark, Meat was the one with a hell of a lot to lose. He had an album effectively already to go, and I'm wiling to bet the label only put up the money for Desmond, Vai, May, publicity, film clips etc because it was contractually due to be called Bat 3. If Jim didn't get handed a big fat cheque in that out of court settlement then I'll eat my hat.
